  • ParkingEye's ANPR misreads registrations and issues erroneous charges; each wrongful charge is an unlawful DVLA data access and a potential data-protection claim.

  • 1. Charging for 'consideration period': ParkingEye calculates parking duration from vehicle entry (ANPR) rather than from the start of the paid parking session, leading to charges for time spent finding a space, reading signs, and paying. This contradicts the intent of the BPA's 'consideration period' and 'grace period'. 2. Denial of appeals based on entry-to-exit ANPR data: ParkingEye consistently denies appeals even when motorists demonstrate payment for the intended duration and exit within the grace period, arguing based on total 'duration on site'. 3.   • The most actionable defect found is the potential for lack of proper planning permission for ANPR camera installations, as indicated by ParkingEye's historical use of 'retrospective planning' where cameras are installed before seeking permission

  • Signage failed to mention alternative payment methods (e.g., app, phone, online) beyond the single payment machine, violating BPA Code of Practice paragraphs 19.3 and 19.7, which require clear signage of all available payment options.

  • Faulty payment machine that failed to process payment, violating BPA Code of Practice paragraph 20.11, which mandates working machines and non-penalization for machine faults. ParkingEye did not provide proof of machine functionality . ANPR records only entry/exit times, not actual parking duration, failing to account for reasonable 'consideration periods' for finding a space and attempting payment, as per BPA Code of Practice paragraph 13.1

  • Appeals are commonly based on faulty payment machines, insufficient grace periods, ANPR inaccuracies regarding actual parking time versus recorded time, and the legal principle of 'frustration of contract' when the operator's equipment failure prevents payment.

  • A SAR can expose that ParkingEye redacts its landowner contract so it looks like the principal when it is only the agent. An unredacted contract (clauses 3.11 and 8) reveals its true agency status and the landowner's knowledge of the charges and access to site data — which undermines its right to sue in its own name.
